Branstad, Legislature nix respite restrictions

Governor Terry Branstad will not support administrative rules limiting Medicaid-funded respite for children and adults with disabilities legally.
The Iowa Department of Human Services has proposed to limit the number of hours families with a disabled member can access the state-based respite - a program of home care to give family members a break from providing care to their family members with disabilities - 48 hours to months. Some families often "bank" their hours of respite so they accumulate.
Families responded significantly to lawmakers in July, after hearing about the proposed cap, saying the proposed rule would affect home care in their family and they would have found institutional care.These families often prefer to keep their relative at home, and community health exemptions describe what relief can be covered. In the case of disabled people more deeply, a respite from some of the exemptions available are endless, but still have minimum guidelines.
In turn, DHS offered a rule that would set an annual limit of 576 hours to be used flexibly. Hundreds of families with deep and severely disabled family members - who use more respite - would still see services cut, however. Lawmakers from the Health and Human Services Appropriations Subcommittee recommended the rules proposed be withdrawn.
This week, Branstad concurred.
“At this time, it did not make sense to go forward with a measure in Medicaid that would place the greatest burden on the most vulnerable,” Branstad spokesman, Tim Albrecht , said Thursday on the Governor’s behalf. “In this case, managing that program wasn’t about dollars, it was about common sense.
